Public procurement

Vojenské lesy a statky ČR, s. p. is a public contracting authority (“the contracting authority”) pursuant to Act No. 137/2006 Sb., the Public Procurement Act, as amended (“the Act”).

The contracting authority does not have to award small-scale public tenders, i.e. tenders, whose value is not expected to exceed CZK 2,000,000 excl. VAT in case of supplies or services, or CZK 6,000,000 excl. VAT in case of construction work; from 1 April 2012 to 31 December 2013, small-scale public tenders were those, whose value did not exceed CZK 1,000,000 excl. VAT for supplies and services, or CZK 3,000,000 excl. VAT for construction work.

The contracting authority must comply with the following principles at all times:

• transparency
• equal treatment
• no discrimination

Public procurement

Over-limit and under-limit public tenders are awarded according to their expected value in CZK excl. VAT in a public procurement procedure in accordance with the law.

Small-scale public tenders are awarded according to their expected value in CZK excl. VAT in a procurement action according to the contracting authority’s internal guideline.

Procurement actions include from 13.1.2015:

direct award
closed call (addressing at least three suppliers who are able to perform a public contract)
open call (publishing on the contracting authority’s profile and informing at least three suppliers, who are able to perform the public contract)

The thresholds of expected value of small-scale public tenders in CZK excl. VAT are determined by the internal guideline of the contracting authority (Code of Conduct – procurement at VLS ČR, s.p.).
Commencement, course and termination of procurement procedures and procurement actions are governed by the law and internal guidelines of the contracting authority
